1. OUR DELIVERY PARTNER
1.1 Our courier is DPD, Primacy Food Village and its employees cannot be held responsible for our courier’s failure to deliver to the specified time due to adverse weather conditions or other circumstances beyond our control. In these instances, we will, however, make our best efforts to correct the problem. Please contact our Customer Care Team on 02891 270083 Option 1 or by email office@primacymeats.com to discuss your concerns.
1.2 DPD offer a ‘predict’ delivery service whereby they inform customers of a one-hour delivery window notified by SMS and/or email – so you don’t have to wait in all day. Additionally, you can track the progress of your delivery on the DPD website https://dpd.ie/tracking.
2.1 ORDERING:
2.1 Delivery costs. The costs of delivery will be as displayed to you on our website.
2.2 You are able to choose an available delivery date and details when you order goods. We will confirm this in a confirmation email to you. We will try to deliver on your selected date but such delivery dates are estimates only and we will notify you if your goods are not able to be dispatched within the agreed timescale for any reason.
2.3 All orders will be treated by the customer as an offer to purchase and will be subject to these terms and conditions.
2.4 Primacy Meats Ltd reserve the right to refuse orders for any reason.
2.5 In cases of out of stock goods, Primacy Meats Ltd will notify the customer. Customers will be given the option to postpone the full delivery and wait on ordered product, take an alternative with the same value, or a refund of the out of stock item which will be processed and into the bank account within 14 days.
2.6 With a growing number of fraudulent orders, we may hold your order and contact you before processing it. On occasion, we reserve the right to ask for an alternative method of payment if we expect the card used does not match the delivery address. All attempts to place false orders or attempts to deceive will be reported to the police.
3. PRICE & PAYMENT:
3.1 Prices are shown inclusive of VAT, where VAT is applicable. Prices are shown excluding delivery charges. Delivery charges will be added at checkout. Prices will be communicated via website and marketing communications.
3.2 All online orders will receive an email confirming details and prices of order.
3.3 No orders will be dispatched or made ready for collection without payment. Primacy Meats Ltd reserves the right to cancel orders and refund customers' money at any time due to pricing errors or other issues relating to accidental misinformation or online error.
4. PERFORMANCE OF SERVICES:
4.1 Primacy Meats Ltd and all third parties (including couriers) will perform all activities in relation to business with all reasonable skill and care. We cannot guarantee services will be error-free or uninterrupted. Primacy Meats Ltd accepts no liability for loss and/or damage to property or purely economic loss resulting from use of products sold or late delivery. We do not offer any form of compensation for any loss of business or damage in any other regard. This does not affect your statutory rights where these may differ. As with all provisions in this document they are set out in accordance with the law of the United Kingdom and most particularly that of Northern Ireland.
5. RIGHTS OF SUPPLIER:
5.1 Primacy Meats Ltd reserves the right to amend pricing at any time without prior warning to customers. Primacy Meats Ltd will make every effort to ensure pricing is correct at the time of ordering. Should an error occur, the order will be put on hold and we will contact the customer to communicate pricing and come to an acceptable solution. Primacy Meats Ltd reserves the right to withdraw any products, promotion, offer or offer code at any time without warning.
6. RIGHTS OF SUPPLIER:
6.1 We are not responsible for delays outside of our control. If our supply of your goods is delayed by an event outside of our control then we will contact you as soon as practically possible. We will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any goods you have paid for but not received.
7. DELIVERY
7.1 If Primacy Meats Ltd are unable to deliver on the agreed delivery date via courier or Click & Collect, the customer will be contacted and a new date will be agreed or a full refund offered if a new date cannot be agreed with customer.
7.2 Primacy Meats Ltd and courier partners will take all reasonable efforts to ensure delivery dates are reached. In any event the order arrives outside the agreed date, Primacy Meats Ltd will not be held liable for any loss, damages, costs or expenses incurred by the customer or any other party directly or indirectly.
7.3 Delivery will be attempted to the address provided. The customer will take all necessary arrangements to ensure the delivery is taken successfully.
7.4 Due to the perishable nature of the products, the courier will be advised to leave them at the address, regardless of someone being able to accept delivery or not. When the parcel has to be left with no signature, Primacy Meats Ltd nor courier will be held acceptable for any damages, injuries, theft or any other costs associated with leaving the delivery unattended.
7.5 Risk of goods will transfer to the customer from the time of successful delivery or when at the first time delivery was attempted.
7.6 Primacy Meats Ltd are unable to amend or change any aspect of delivery 7am the day before your selected delivery date.
7.7 Risk in the Goods shall pass to the Buyer upon delivery of the Goods, or where the Buyer fails to take delivery at the agreed time, at the time delivery was attempted.
7.8 Title of goods will pass to the customer when full payment has been received.
8. CANCELLATION & RETURN
8.1 Customers may cancel their order for any reason up to the point the Farm Shop start to prepare your order (7am the day prior to delivery) for a full refund or credit. Any payments refunded will be processed and into bank account within 14 days.
8.2 For products concerns, Primacy Meats Ltd may ask for the goods to be returned before refund/credit is processed. If a defect is found, postage costs for the return will be accepted.
8.3 If you receive Goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 2 days to arrange and return. Primacy Meats Ltd is not responsible for paying shipment costs. You will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods. Refunds and replacements will be issued upon our receipt of the returned Goods.
8.4 All returns must be approved by Primacy Meats Ltd prior to sending. Please call or email to discuss and obtain returns details.
8.5 No return will be accepted without prior warning.
8.6 If Primacy Meats Ltd receives no communication from you within 24 hours of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in good condition and with no problems.
9. FORCE MAJEURE
9.1 Primacy Meats Ltd shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control. These include, but are not limited to, acts of God, strikes, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials and Primacy Meats Ltd shall be entitled to a reasonable extension of its obligations.
10. SEVERANCE
10.1 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
11. CHANGES TO TERMS & CONDITIONS
11.1 The Supplier shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
Governing Law & Jurisdiction. These Terms and Conditions shall be governed by and construed in accordance with the law of Northern Ireland and the parties hereby submit to the exclusive jurisdiction of the courts in Northern Ireland.
